One of the things in life that is definite is death. Unexpected death is also a possibility. Accidental death is the term that defines death that happens when not expected. It may happen due to someone’s negligent actions. According to the Center for Disease Control and Prevention (CDC), there are 123,706 cases of wrongful death in 2007.

All details provided as a reference only, contact a Wrongful Death Attorney in New York where required.

The figures are quite alarming. According to CDC, the major cause of wrongful death in the US is due to car accidents. There were roughly 42,031 fatalities from car accidents. In 2005, car crashes were the major cause of accidental deaths; 300 people who are at least 45 years old were fatally injured.

Other causes of wrongful death include poisoning, traumatic brain injuries, workplace, unsafe premises, and medical malpractice.

There were roughly 29,846 cases of fatal poisoning. Slip and fall cases reached a toll of 19,656 deaths. The major causes for slip and falls are malfunctioning ladders, danger zones with insufficient safety marks, stairways without proper railings, and dark, slippery, and blocked walkways.

Accidental deaths in the workplace are also common. The US Department of Labor reported that the number of deaths in the workplace in 2006 reached a total of 5,840.

Here are the relevant statistics:

There were 2,459 fatalities from motor vehicle crashes

There were 788 fatalities that resulted from by an assault or other violent acts

993 fatalities that were caused by workers who deal with dangerous or hazardous machines

827 fatalities due to falls

547 fatalities occurred due to contact with harmful substances

According to CDC report, in 2007, there were 29,846 of poison fatalities. Nevertheless, the most usual cause of wrongful death is traumatic brain injury, with a total of at least 50,000 cases. Medical malpractice is another common cause of wrongful death, with about 100,000 cases; 7% of these are due to errors in medication.

The National Highway Traffic Safety Administration (NHTSA) reported recently that approximately 18 out of 100,000 vehicles are implicated in severe traffic accidents annually. This similar report stated that about 55 out of 100,000 motorbikes are caught up in accidents that resulted in casualties.

Details provided for information only, contact an experienced Long Island motorcycle accident attorney for additional details.

The information from the National Highway Traffic Safety Administration show that more than 5,000 people driving motorbikes pass away annually. At least 4 million motorbikes have their registrations in the USA and 5% of every highway deaths include one of these motorbikes. The biggest concern is that motorbikes present no safety measures to the motorbike drivers.

The United Kingdom UK Department of Transportation statistics show that motorbike drivers have 16 times greater possibility to undergo severe injuries than drivers using four-wheel vehicles. The information stated that motorbike fatalities keep on increasing annually. The fatality rate is 30 times more as compared to fatalities in other means of transportation.

The Australian Transport Safety Bureau reported that motorbike drivers below the age of 40 have the greater possibility to die compared to riders of a similar age group who operate some other means of transportation. Motorbike drivers below 40 have 36 times greater susceptibility to severe injuries, and motorbike drivers past 40 have 20 times greater susceptibility.

The Hurt Report Shows that 75% of Motorcycle Accidents Include Automobiles

The Hurt Report printed in 1981 is just the only available motorbike safety research. The research had listed 55 results and a number of proposals which may assist in improving law enforcement and legislation. The research illustrated that greater than 60% of motorbike accidents are a result of rider miscalculations and that using the right gears and a helmet shall radically reduce severe incidents.

A major cause of motorbike accidents is mainly the neglect of other drivers to notice or distinguish motorbikes in traffic because of insufficient lights on the motorbikes, and the negligence to use defensive gears in appropriate color. On the occasion where a motorbike driver loses control of driving and a crash happens, several injuries occur from the accident.

Crashes involving road signage, lamp posts, and side railings lead to severe injuries such as broken bones, back and spine injuries, and injuries on the joints. Traumatic brain injuries and head injuries are more often than not the consequence of violent crashes on the road, a lamp post, or a signage. Motorbike drivers wearing helmets decrease the danger of serious head injuries by about 40%.

Personal protective equipment (PPE) may lessen serious injuries. Full-face helmets, Kevlar knuckle cosseted gloves, padded nylon, Cordura or Kevlar garments, goggles or a helmet visor, and crafted boots give protection to the ankles and toes and are the most excellent ways to minimize damages, as per the NHTSA.

The details herein provided are for informational purposes only, contact an Phoenix dental malpractice attorney where required.

In 2009, a juvenile from Kansas suffered brain injuries and other neurological problems. During extraction of four wisdom teeth, he was incorrectly given nitrogen oxide instead of oxygen during the dental procedure.

In 2005, a patient who is identified to have a hereditary angioedema, a type of immunity disorder, died after extracting his wisdom teeth.

In 2003, a man suffered from numbness on his lip, chin, and jaw. During an extraction, the dental practitioner incorrectly drilled the wrong part of the patient’s mouth.

In 2002, a lady had an extraction on her wisdom tooth which resulted to several complications, including chronic pains, damages to the nerves, and Temporo Mandibular Joint (TMJ) disorder. This led to further complications with her internal organs; eventually, she had to undergo a surgery to remove a large part of her large intestine, small intestine, as well as her reproductive organs.

In 1993, a dental procedure (extraction of wisdom teeth) was performed on a young boy. This dental procedure led to his demise.

During the period of 1982 to 1983, at least ten patients of a particular dental practitioner suffered chronic injuries, particularly damages on the nerves.

In New York, a patient suffered from permanent paresthesia. Paresthesia refers to a condition where a person experiences numbness and prickling sensation on the skin. The patient also suffered from inferior alveolar nerve damage, which caused numbness on her chin and lips.

In California, a dental practitioner cut a patient’s lingual nerve. As a result, the patient experienced loss in taste and sensation.

In Missouri, after a wisdom tooth extraction, a patient suffered from Temporo Mandibular Joint (TMJ) disorder, damaged mandibular and lingual nerves. This resulted to several side effects, including pain in the face, jaw, neck and ears, gritting teeth, numbness, headaches, and dizziness.

When you are suffering from injuries as a result of another’s negligence, you probably want to consider the process of filing a personal injury case. The process can overwhelm you especially if you look at the whole procedure but if you understand the main concept behind it and do little steps, the process will likely appear to be easier.

All details herein provided are for educational purposes only, contact an experienced Valparaiso personal injury lawyer for more details.

Your first step is to consult with a lawyer who specializes in personal injury. Referrals and checking the Internet for local lawyers are your options. There must be a minimum of three lawyers to choose from so that you can choose the one whom you can work with the best. After hiring a lawyer, the lawyer must clarify the procedure for filing a personal injury case; the lawyer must also explain which documents you need to accomplish.

During the process of data gathering, both parties shall get as much data as required from the other so that all facts pertaining for the case are identified. Legal documents shall be sent to each party; the lawyers can file a Motion to Dismiss prior to the trial. The injured party and its lawyer shall have a meeting with the other party and its lawyer for settlement. Most of the time, settlements are preferred rather than proceeding with the lawsuit.

Should a settlement does not resolve the case, then the trial will commend. Every party has the chance to testify and present witnesses to confirm their evidence. The lawyers will provide their closing arguments and the jury will deliberate on the final decision.

If the lawsuit is successful, the injured party shall be granted a monetary compensation based on the jury’s decision. However, the monetary compensation is not given instantly; you will be informed how to collect the money as required.

If the verdict does not prove satisfactory to one of the parties involved, they can file an appeal.

There are a wide range of instances where a person can be injured, or hurt; of course the severity of the injury will depend upon the incident itself and/or the circumstances of such an event. This is perhaps the central theme of the definition of a personal injury from a legal perspective, or within a claim for compensation for such an injury or injuries sustained.

First and foremost it must be mentioned that this information is intended as a discussion of personal injury and should not be viewed as an accepted legal definition or legal advice in manner or form whatsoever. It is highly recommended to consult with a qualified legal practitioner, lawyer or attorney for sound legal advice.

Briefly stated a personal injury is considered to be a violation of an individual’s right, other than his or her rights in property, according to West’s Encyclopedia of American Law. This taken together with the fact that such personal injury is not limited to the physical nature thereof requires that the body, mind and emotions of the individual or individuals must be taken into account within considering any such personal injury.

What can give rise to or cause such a violation of an individual’s right?

Research provides the concept of negligence arises throughout the majority of discussions pertaining to personal injury and personal injury claims. The proof of such negligence of another is or is not established during the claims process, as well as the extent of such injuries sustained. Within the context of the law within the United States this process can prove to be somewhat complex, and hence the continued recommendation of working with an attorney that is focused and experienced within personal injury cases and proceedings.

Where do personal injuries most often occur?

In saying where, this is meant to signify areas that personal injuries most occur, and include the following:

Accidents – Car, Motorcycle, Truck and related modes of transportation accidents;

Medical – dental and medical malpractice;

Dangerous Drugs – prescription drugs that have significant and dangerous side effects;

Defective Products – products that are unsafe and may cause injury or even death;

Workplace Accidents – injuries at work due to machinery or defective equipment that has not been properly maintained;

Industrial diseases – exposure to harmful materials, the most well known perhaps is that of asbestos and the resultant mesothelioma disease;

Toxic substances – negligent dumping of substances affecting surrounding communities; and so forth

As can be seen there are a number of circumstances that can be deemed or proven that negligence may well have been present on one party or another, and it can furthermore be seen as to the possibility of complexities arising from these circumstances, especially considering the fact that many of the corporations or companies that may be accused of such negligence will in all likelihood defend their names, their profits and their interests by using their teams of legal experts and attorneys. Again highlighting the need of having a personal injury attorney and law firm on your side, who will fight for your rights in any personal injury claim or proceeding.

Remember that this is not exhaustive within the consideration of personal injuries, view our disclaimer and consult with a qualified attorney where required.

If you are involved in an auto accident there are some things you need to be aware of. The insurance company of the person at fault will do everything in their power to minimize their potential losses. They do not care how injured you are or how bad the car crash was. Their main focus is to pay out as little as they possibly can. Within several days their representatives will come to your home attempting to gather personal information, obtain a release on your medical records, or get any type of statement that can be used against you, as the personal injury victim, in the future.

You would think these less than ethical methods would be against the law but they are not and the more knowledge you have the better off you you will be.

Understand and follow these suggestions:

Do not speak with the insurance company of the person at fault. No matter how friendly them seem to be, no matter how genuine they come off, do not say anything at all to them. They are looking for any information that will discredit you in the future and they are not your friend. You are not obligated under Oregon law to cooperate with them whatsoever. This especially includes your medical condition. There are people who can negotiate with these individuals, a personal injury lawyer or your own insurance company, but you are not one of them.

If you are asked for a medical release say “no.” Anything you are asked of as far a providing additional medical information, past, present, or future should be meet with a resounding denial. Insurance companies want this information in an attempt to prove later on that you were “already injured” and that the accident was not the true cause of your current condition. They will go well beyond the actual accident to get out of compensating you. Under no circumstances, not even if they seem like the nicest people in the world, should your release any medical or health records to them. Failure to follow this advice could prove disastrous.

Within forty-eight hours you will hear someone knocking at your door. It will be an agent of the insurance company. Do not answer it and if you do politely tell them to leave. Keep in mind that they are trained, like a used car salesman, to be your friend and act like they care about you. This trick has been used many times and has come back to haunt many Oregon car crash victims who have fallen for it. Again, these people are building a case against you so why would you help them with anything!

You may think your own insurance company is on your side but remember they employ the tactics just mentioned as well. Additionally, under Personal Injury Protection aka PIP they are paying many of your benefits. Your cooperation is mandatory with them though. You cannot just brush them off or they can cut your benefits. But do not go to doctors they send you to and be wary if they try to force you. These “doctors” are working for them and their analysis might not be in your best interests. Nevertheless, because they are a “doctor” their prognosis may hurt your case in the future when its being negotiated. If you feel like your own insurance company is trying to screw you then get a personal injury or car accident lawyer (both the same thing) immediately.

If you are involved in a major automobile collision you need to realize that a lot of money is at stake. Depending on the circumstances and how bad the accident was you could be in line to receive hundreds of thousands, maybe millions. The insurance companies know this and will do whatever it takes to stop this from happening. They have no conscience and the sole job of protecting their corporate profits. Treat them as you would an enemy in war. Remember they are battle tested and have gone through this many times while you, obviously, have not. Get professional legal counsel from a trusted source and hire someone who has a proven track record of going “toe to toe” with them and winning.

When it comes to personal injury cases in Oregon your credibility means a lot. This is regardless of whether you are suing because of automobile accident, medical malpractice, legal malpractice, sexual harassment, product defect, or any other personal injury case.

If you become deemed as an “non-credible person” you could seriously jeopardize thereby wasting not only your time but that of your injury attorneys. Quite recently I read a blog post of a personal injury attorney withdrawing from a case because his client keep lying to him. He came to the point where he could not trust the person he was defending and did not want to pursue the case any longer!

So why should you be concerned with your credibility?

If your case goes to trial then it will ultimately be the jury’s decision as to whether you win or not. For them to award you a large settlement they will have to a) like you and b) feel somewhat sorry for you. You will have to gain their sympathy. This will not happen if they do not believe you and one lie can invalidate the rest of your testimony. Jurors are only going to relate to someone they feel is a truthful and hardworking person who was a victim of someone else actions either knowingly or unknowingly.

Oregon personal injury lawyers will tell you in a minute that they would prefer to represent Mohandas Gandhi on a case with little to no evidence than Joseph Stalin on a case that seems like a clear winner. Not only wouldn’t the jury trust the latter but they would not feel sorry for him one bit. They would reason that “he got what he deserved.”

What Is Involved in Being Credible?

Being seen as a credible plaintiff involves more than just not lying. It involves being accurate and being detailed even on seemingly small issues. You have to make sure that you can relate every part of your deposition again, and again, and again with nothing changing each time.

The attorney who is defending the person or business who you are suing is trained to hear irregularities. If you change your story or misstate something, even on accident, the defense’s attorney will call you on it. It could have been a really small and 100% just an accident. But you will be attacked for him and your whole testimony will be called into question. The other attorney may reason with the jury that “if you were mistaken on this part how many other parts are ALSO mistaken.”

Suggestions and Steps to Stay Credible

Good Oregon personal injury attorneys will work with you to improve your credibility. Its his or her job to make sure every piece of your testimony is thorough, accurate, verifiable, and true.

You will also be told what pieces of information you need to keep track of, how to keep track of important information so that you can easily recall it, be fully informed what the witnesses are saying about your case that you may be unaware of, memorize your deposition like you would an important exam you need to score extremely high on to get into college, and be informed of potential traps the other attorney might throw at you.

Here is a nice article written by Eric Hageman which outlines ways plaintiff can win credibility battle in a personal injury case.

Your deposition will be attacked so be ready for it. If you are able to keep your story the same, no matter what, you will be ahead of the game. Its not easy but everything must be done to minimize inconsistencies as much as possible through if the case drags on this is easier said than done as people naturally forget everything that happened. Attacking your credibility is a major weapon of opposing lawyers and when you neutralize that you have a clear advantage. Establish yourself as a person who is truthful and accurate and you can win a very large settlement that will help you and your family in years to come. Become a “lair” in the jurors mind and you have no hope of possibly winning.

You make an insurance claim in Oregon. The company reviews it, gathers information, and then denies it based upon some misstatement in your application. Can the insurance company do that? Maybe. Maybe not.

When you make an insurance claim in the state of Oregon the company who is providing coverage has the right to “accept” it or “deny” it based on the application and information they receive.

With the laws currently on the books in Oregon one mistake can be enough for them to deny your application. In this state the rules regarding this are not well done. Many lawyers will personally attest to that. It has gotten so bad that quite recently the Oregon State Insurance Division has put out a bulletin letting insurance companies know what they consider proper and what they consider improper when reviewing claim applications.

Here are some key points that this department wants to get across to the public and insurers in the state:

Intimidation will not be accepted of any kind for people applying for insurance benefits. This includes attaching large “warnings” on claim forms in bold print in an effort to scare of the person filling it out.

An insurance company cannot just cancel a contract or deny a claim based on one small misstatement. There must be sufficient evidence or belief that the information provided on the application is downright false or twisted in a way to benefit the person making the claim more than it should. Claims should not be denied based on minor miscalculations. The misstatement or concealment must be intentional or must prove that the initial application that was filled out was not accurate.

This can apply to health insurance, life insurance, auto insurance, workers compensation insurance, or property insurance.

When dealing with insurance companies in Oregon it is best to find a lawyer who can help you every step of the way. You might even want to have one present when you are filling out the claim application so he can guide you. The risk on having a “misstatement” will be minimal when you have a qualified personal injury attorney with you.

Keep in mind that insurers are in business to collect your premiums, from you or your employer, and to deny as many claims (valid or fraudulent) as they possibly can. They will do whatever they can within the framework of state law to not give you the benefits that you deserve. Their history is well documented. Please, find an attorney who is well versed in all of their tricks and who can throw it right back at them.
